LAST WILL AND TESTAMENT
OF
ANNA FABINI
I,ANNA FABINI,WIDOW,a resident of Union Township,
Washington County,Pennsylvania,being of sound mind and memory,
hereby revoke all wills and codicils,as well as all instruments
of a testamentary nature heretofore made by me,and do hereby
make,publish and declare this to be my Last Will and Testament
in manner and form following:
FIRST :I direct that all my just debts,funeral
and testamentary expenses shall be paid by my Executor or Executrix
hereinafter named,as soon as conveniently may be after my death.
SECOND:I give,devise and bequeath to my son,
JOHN FABINI,his heirs and assigns,my mobile home,together
with my household furnishings and the personal effects of whatso-
ever kind and nature contained therein which has been placed on the
land which I conveyed to John Fabini,et ux.,by deed dated.
August 26,1969 and of record in the Office of the Recorder of
Deeds in and for Washington County,Pennsylvania,in Deed Book
Volume 1304,page 736.I also give,devise and bequeath to my
son,JOHN FABINI,all my rights in and under that certain oil and
gas lease to the Greensboro Gas Company dated December 14,1919,
which contains the right to receive gas for lighting and heating
the dwelling house and with the free and uninterrupted right to
water from the spring and all my right,title and interest in and
to that certain right-of-way which is jointly used and maintained
by him and Joseph F.Gazetsky and Margaret A.Gazetsky,his wife,
from the premises I.conveyed to him by deed dated August 26,1969
to the Mingo-Courtney Road,which is fully se~out in the survey
made by John T.McClure,Registered Surveyor,in July,1969.
THIRD:I give and bequeath to my daughter,ANNE
ALEXOF,of Oak Ridge,Tennessee,her heirs and assigns,the sum
of Two Thousand and No/lOO ($2,000.00)Dollars.
FOORW:Having already provided for my son,JOHN
FABINI,and my daughter,MARGARET A.GAZETSKY,during my lifetime
through the conveyances to them of certain real estate,I then
give,devise and bequeath all the rest,residue and remainder of
my property,real,personal and mixed,wheresoever situate,of
which I may die seized or possessed,or over which I may have
testamentary control,or to which I may be in any way entitled,0
whatsoever the same may consist,to my son,CHARLES S.BEROES,
his heirs and assigns.
FIFTH:I hereby nominate and appoint PITTSBURGH
NATIONAL BANK,its successors or assigns,as Guardian of any
property which passes to a minor and with respect to which I am
authorized to appoint a Guardian and have not otherwise specifically
done so,granting it in this capacity the power to agree to any
distribution of the said property that it deems advisable;the
power to retain any property,real or personal,received by it
in kind and the power and authority to option and sell the same
upon such terms and conditions as it believes advisable,giving
good title to any real estate thus sold;and the power and authority
to invest in such stocks,bonds and/or other investments it
deems advisable,without being limited to those investments in
which guardians are by law required to invest minors'funds;and
the power and authority to disburse to or for the benefit of
the minor wards so much of the income and the principal of the
minor's share of the said property as it,in its sole discretion,
deems advisable for the minor's comfort,maintenance,support and
complete education,including preparatory,college and post-
graduate or professional training,and to aid the minor in the
event of any illness,injury or other emergency affecting the
minor wards wherein money is needed.Any disbursements herein-
above authorized may be made to the parent,guardian or such
other person as may have custody of the person of that minor at
the time such payments are made,without liability on the part of
PITTSBURGH NATIONAL BANK to see to the application of said payment
by the payee,and the receipt of any such person shall be a full
acquittance of PITTSBURGH NATIONAL BANK as to any amount so paid.
SIXTH:I hereby nominate,constitute and appoint my
son,CHARLES S.BEROES,as the Executor of this,my Last Will and
Testament,to serve without bond.Should my said son die in my
lifetime,or shall he refuse or be unable to act,then in such
event I hereby nominate,constitute and appoint my daughter,
ANNE ALEXOF,as the Executrix of this,my Last Will and Testament,
to serve without bond.
SEVENTH:I hereby grant to my Executor or Executrix
full power and authority in his or her discretion,to option and
sell all or any part of the real estate or personal estate of whic.
I shall die seized or possessed,at public or private sale,for
cash or on credit and on such terms and conditions as she or he
may deem expedient,and good and sufficient conveyances therefor
•
to execute and deliver.In addition to the po~ers given my Execut r
or Executrix by law,he or she shall have discretionary power to
compromise controversies and to make distribution hereunder to any
person entitled thereto in kind,in caSh,or partly in kind and
partly in cash,as she or he may deem advisable.
IN WITNESS WHEREOF,I have on this ~day of October,
A.D.1974,signed,sealed,published and declared the foregoing
instrument as and for my Last Will and Testament in the presence
of each and all of the subscribing witnesses each of whom I have
requested in the presence of the others to subscribe their names
as attesting witnesses,in my presence and in the presence of the
others.
This instrument,consisting of four (4)typewritten
pages was subscribeo,sealed,published and declared by ANNA
FABINI,the Testatrix above named,as and for her Last Will and
Testament in our presence,and in the presence of each at us,and
we at the same time,and at her request and in her presence and
in the presence of each other,hereunto subscribed our names and
addresses as attesting witnesses this -lJl day of Octobe~.A.O.
