ITEM ONE.I direct the payment of all my just debts and those of my estate,including funeral expenses,as soon as may be found convenient after my decease.I further direct that my Executor payout of my estate,a general charge thereon,all estate and inheritance taxe that may be assessed by reason of my death,without bursement therefore being required,of or requested fro any devisee or legatee hereunder or from any beneficiar of any life insurance policy on my life. ITEM TWO.I give,devise and bequeath to ALICE LU9INDA DUKE,my wife,if she survives me,all the rest,residu and remainder of the property which I may own or which I have the right to dispose of at the time of my death, of whatsoever character and wheresoever situated. If my wife does not survive me,I give,devise and bequeath said property to Ada Alma Ullom,my step- daughter of Tridelphia,West Virginia;WALTER CONRAD HEYER,My step-son,of Wheeling,West Virginia;and to MARGARET THOMAS,who I raised as a child,of Glassport, Pennsylvania,in the following propovtions;ADA ALMA ULLOM--(40%)percent;WALTER CONRAD HEYER--(40%)per- cent;and MARGARET THOMAS--(20%)percent of my estate, per stirpes. ••• ITEM THREE.I nominate and request the appointment of ALICE LUCINDA DUKE,my wife,to be Executor,of this, my last Will and Testament,and in case she should die in my lifetime,or shall decline to act,I nominate and request the appointment of WALTER CONRAD HEYER,my step- son,to be Executor of this,my Last Will and Testament. I direct that no bond be required of the Executor named in this Will. ITEM FOUR.I confer upon my Executor named in this Will, authority to sell and convey any part or all of my es- tate,real or personal,at such prices and upon such terms as he shall deem proper.I authorize my Executor to compromise and settle any and all claims in favor of or against my estate,for such sums,upon such terms and in such a manner as he shall deem for the best interests of my estate.I further authorize my Executor to per- form such other things as he shall deem necessary or desirable for the proper administration of my estate, and to execute and deliver such instruments as may be required in the discharge of his duties,the generality of this provision not being limited by any of the speci- fic powers herein granted to him.The authorities vested in my Executor may be exercised by him without the necessity of applying to any Court for leave or conformation.
