FIRST:I direct that my executor pay all of my just debts and funeral expenses as soon as convenient following my decease and direct that I be intErred in the Monongahela Cemetery and that,if it has not alread:r been d::me,hE pay for the removal of such of my relatives as are still in the Gilmo~e Cemetery to the Monongahela Cemetery. SECOND:All the rest,residue and remainder of my estate,whether. real,personal or mixed and wheresoever the same may be situate,I give,devise and bequeath unto Malcolm Anderson,in trust,however, unGer the following terms and uses: (A)In the discretion of my trustee,to operate or liquidate all businesses or interest in businesses which I possess at the time of my death,and in the event of liquidation,to invest my money in legal invest- ments. (B)Out of the income of my estate,to pay the operating expenses and to pay the net balance in semi-annual payments,to Walte::, Gilmore,Samuel Gilmore and Malcolm Anderson,in equal shares.In the event of the 6eath of any of the above named b'3neficiaries,the net incc,me is to be divided among the survivors. (C)This trust is to terminate upon the death of both Walter Gilmore and Samuel Gilmore. (D)Upon the termination of this trust,the entire balance of the trust I give,devise and bequeath unto Malcolm Anderson,his heirs and assigns forever. THIRD:1"1.order to aid my executor and trustee in the administration cf my estate,I wish to make this statement as to my operation of the North Webster or Susanna Mine. All my interest in the mine in the lease with the Pittsburgh Coal Company and in all equipment and machinery acquired prior to July 1,1953 is mine absolutely.Subsequent to that date,any equipment purchased or other possessions acquired in connection with the operation of this mine shall belong to myself,Alexander JohnSon and William Little, in equal shares.In the event of my death,my trustee is authorized to continue this business and enter into an agreement with these two men similar to my own agreement,but if they fail to cooperate with my trustee,then he is instructed to liquidate the operation and distribute the proceeds as indicated above,that is,Alexander Johnston and William Little are entitled to one-third (1/3)each of the value of any assets ac- q:lired subsequent to July 1,1953,and to one-third (1/3)of the net income u"1.distributed as 0:that date.
