On the 12th day of August 1953,there was duly filed
in said Court,a certain instrument in writing purporting to be

the Last Will and Testament of alter W.Davis,deceased,together
with an Application to admit same to probate.Thereafter notice
thereof was duly issued according to law or the same was duly
waived,and the testimony of subscribing or other Witnesses was
taken in open Court,or by commissio~issued as prescribed by
law,and was reduced to writing and filed in said Court.There-
upon,on the 3rd day of September 1953,said Will was admitted
to probate and ordered to be recorded,as appears in Journal 82
page 361 of said Court.
Which said Application,aivers,Notice,Testimony,and
said Will are as follows:

BE IT REMEMBERED that
on the 12th day of August,1953,
during a term of the Probate
Court,begun and held at the Court House in the City of Painesville
County of Lake and State of Ohio on the 1st day of May A.D.1953,
by and before J.Frank Pollock,Judge of said Court,the alleged
Last Will and Testament of Walter W.Davis,deceased,late of
Painesville City,in said County,was produced and filed by valter
R.Davis,who at the same time made Application to have said Will
admitted to probate.
And it appearing to the Court that John C.Krebs,one of
the sUbscribing witne~ses to said Will,is a resident of Hanover,
Pennsylvania,and therefore without the jurisdiction of the
Court,-
It is therefore by the Court ordered that Harvey A.
Gross of York,Pennsylvania be and he is hereby appointed Commis-
sioner to take the Deposition of said subscribing witness.
Commission with the will annexed issued and this cause 1s
continued.

to take the Deposition of Bernadette Krichten,one of the sub-
scribing witnesses to said Will,was returned and filed,duly
executed.
~nd it appearing to the Court from the depositions so
taken,that said Will was duly executed and attested and that
said Testator,at the time of executing the same,was of full age,
of sound mind and memory,and not under any restraint,-
And the surviving spouse and next of kin of said decedent
known to be resident of Ohio having waived the issuance and servic
of notice and consented to the probate of said Will,-
It is therefore by the Court Ordered and Decreed that

This day came Lydia T.
Davis and filed herein a state-
ment under oath of the nature
and value of the estate of Walter W.Davis,deceased,late of
Painesville,in said County;also the names and P.o.addresses
of the surviving spouse and next of kin,and at the same time
made Application to be appointed Executrix of said estate.
Thereupon the Court finds that the allegations of said
petition are true;that said decedent at the time of his death,
was a resident of and left an estate in this County.And smd
applicant being the same person named as Executrix in the Last
Will and Testament of said decedent,-
It is therefore by the Court ordered that said Lydia T.
Davis be and she is hereby appointed Executrix of said estate
and Bond being waived by Will)the same is hereby omitted unless
hereinafter required by the Court.Appraisers appointed and
Letters Testamentary issued accordingly.
