LAST WILL AND TESTAMENT I,HELEN ANNA ANKLEY,of Mount Pleasant Township, Washington County,Pennsylvania,do hereby make my Last Will and Testament and revoke all wills or any codicils by me at any time heretofore made. FIRST:I direct the payment out of my estate of all my just debts,funeral expenses,costs of administering my estate and all estate,succession and transfer inheritance taxes as soon as convenient after my decease. SECOND:All the rest,residue and remainder of my estate, real,personal and mixed,I give,devise and bequeath to my beloved husband,George Edwin Ankley;conditioned,however,that in the event of his death in my lifetime,or in the event of his death within the period of thirty days after my death,the said devise and bequest of residue shall lapse or be divested,and in either event,I thereupon make the bequests and devises more particularly set forth in the paragraphs numbered "THIRD","FOURTH","FIFTH"and "SIXTH"hereinbelow.I declare it to be my intention that should my said husband be living at the expiration of thirty days from the date of my death the estate hereby devised and bequeathed to him shall vest in him absolutely and in fee simple,free of all conditions.I authorize my personal representative to payout of the income or principal of my estate reasonable amounts for the support and maintenance of my said husband and as well the reasonable expense of his funeral and grave stone,should he die within said period of thirty days. THIRD:In the event the devise and bequest made unto my beloved husband in Paragraph numbered "SECOND"above lapse or be divested by the provisions of said paragraph,I give,devise and bequeath unto my daughter,Helen Margaret Ruffennach,in fee simple all real estate situate in Mount Pleasant Township,Washington County,Pennsylvania,of which I die seized,Subject to,and charged with,the payment of one-third of the appraised.value thereof to my son,George W.Ankley,and Subject to,and charged with the payment of one-third of the appraised value thereof to my son,Robert E. Ankley.The value of said real estate shall be appraised as of the date of my death and the appraisal shall be made not later than three months after the date of my death.The appraiser shall be selected by my personal representative or personal representatives; but if any of my three children shall object to the identity of the appraiser so selected,the selection of such appraiser shall be made by the Presiding Judge of the Orphans'Court Division of the Court of Common Pleas of Washington County,Pennsylvania,My said daughter,Helen Margaret Ruffennach,shall pay unto my said sons, George W.Ankley and Robert E.Ankley,their respective one-third shares of the appraised value of said real estate on a date which is nine months after the date of my death or one month after the date of the Adjudication and Decree and Schedule of Distribution made pursuant to the Final Account of my personal representatives, whichever date later occurs. FOURTH:In the event the devise and bequest made unto my beloved husband in paragraph numbered "SECOND"above lapse or be divested by the provisions of said paragraph,I give,and bequeath unto my son,George W.Ankley,my "fou:r;-poster bedroom suite". FIFTH:In the event the devise and bequest made unto my beloved husband in paragraph numbered "SECOND"above lapse or be -2- divested by the provisions of said paragraph,I give and bequeath unto my daughter,Helen Margaret Ruffennach,all my household goods, furniture and household furnishings,except my "four-poster bedroom suite"herein-above given and bequeathed unto my son,George W. Ankley. SIXTH:In the event the devise and bequest made unto my beloved husband in paragraph numbered "SECOND"above lapse or be divested by the provisions of said paragraph,I give,devise and bequeath all the rest,residue and remainder of my estate,real, personal and mixed,of whatsoever kind and wheresoever situate and not otherwise devised or bequeathed in paragraphs numbered "THIRD", "FOURTH"and "FIFTH"above,equally unto my three children, George W.Ankley,Robert E.Ankley and Helen Margaret Ruffennach, share and share alike. SEVENTH:By reason of my confidence in Adolph L.Zeman, Esquire,and Robert L.Zeman,Esquire,I direct that my personal representatives employ the said Adolph L.Zeman or Robert L.Zeman or any person associated with them in the firm of Zeman and Zeman to act as attGrney in the settlement of my estate. EIGHTH:I do hereby nominate,constitute and appoint my said beloved husband as executor of this,my Last Will and Testament; but if my said beloved husband be deceased or unwilling or unable to act in that capacity,then I do hereby nominate,constitute and appoint my sons,George W.Ankley and Robert E.Ankley,as executors of this,my Last Will and Testament. -3- NINTH:Neither my personal representatives herein named or hereafter appointed shall be required to post bond or any additional security in any jurisdiction,in which such personal representatives shall be required to serve.
