Register LAST TVILL AND TESTAMENT OF EVA J.FULTON I,EVA J.FULTON,of the City of Washington,Washington County,Pennsylvania,being of sound and disposing mind,memory and understanding,do hereby make,publish and declare this as an for my Last Will and Testament,hereby revoking and making void all other wills,codicils or testamentary writings by me at any time heretofore made. FIRST:I direct that all my just debts and funeral ex- penses be paid and discharged as soon as conveniently may be done after my decease. SECOND:I direct that all taxes of the kind and nature commonly known as death taxes,including inheritance,legacy, transfer,succession and estate taxes,State and Federal,be paid out of my gross estate after the deduction of the expenses re- ferred to in the preceding paragraph. THIRD:I give,devise and bequeath my house and lot situate in the City of ashington,Washington County,Pennsylvani~, known and designated as 452 Second Street,together with the fur- niture and furnishings located therein,to my daughter,Jean Fos- ter,absolutely and forever.In the event my house and furnishinfs aforesaid,may be sold prior to my decease,then I give,devise and bequeath the sum of Twenty Thousand ('20,000.00)Dollars,to my daughter,Jean Foster,absolutely and forever. FOURTH:I give,devise and bequeath the sum of Five Thousand ($5,000.00)Dollars to the Mellon National Bank and Trust Company,Trustee,in trust,nevertheless,under the follow- ing terms and conditions: a)The Trustee shall invest and reinvest the said Trus Estate or any part thereof in any kind of property,real or per- sonal,including without limitation,mortgages,common stock,pre ferred stock,bonds,notes and other securities as said Trustee may deem proper regardless of whether the same are legal invest- ments for trust funds as now or hereafter defined by law. b)The Trustee shall use and/or pay so much,as in its sole discretion,it deems necessary of the net income,from the trust fund for the maintenance,support and education of Dale McCormick,for and during the terms of the natural life of the said Dale McCormick and at his death to pay any accumulated in- come or principal of the said trust fund that may be remaining to Betty McCormick,her heirs and assigns. c)In the event the net income shall be insufficient at any time,in the opinion of the Trustee,for the proper main- tenance,support and education of Dale McCormick,then the Truste is authorized and directed to use so much,from time to time of the principal of said Trust Estate as in the opinion of the Trust e may be advisable for said maintenance,support and education. FIFTH:In the event my estate is large enough to carry out the provisions of Paragraphs First,Second,Third and Fourth hereof,and there is sufficient cash left to make the following I bequests,then and in that event,I give and bequeath the follow- ing: a)I give and bequeath the sum of One Thousand ($1,000.00)Dollars to Harry B.McCormick of Yukon,Pennsylvania, his heirs or assigns. b)I give and bequeath the sum of One Thousand ($1,000,00)Dollars to John H.McCormick of R.D.1,Jamestown, Pennsylvania,his heirs or assigns. c)I give and bequeath the sum of One Thousand ($1,000.00)Dollars to Dorothy Margaret McCormick,of Munhall, Pennsylvania,her heirs or assigns. SIXTH:I give,devise and bequeath all the rest,resi- due and remainder of my estate,real,personal and mixed,of what soever kind and nature and wheresoever situate,of which I die seized,or to which I may in any way be entitled to my daughter, Jean Foster of Richmond,Virginia,her heirs and assigns.
