LAST WILL AND TESTAMENT
I,SHAN M.GRIFFIN,also known as J.SHAN GRIFFIN,of the
Borough of East Washington,County of Washington,and State of
Pennsylvania,do hereby make,publish and declare this,my Last
Will and Testament,hereby expressly revoking all wills by me at
any time heretofore made.
I am the owner of certain property known as Nos.28,30
and 32 North Main Street in the Third Ward of the City of Wash-
ington,Washington County,Pennsylvania,the same fronting 40 feet
and extending back of even width,more or less,240 feet to
Diamond Alley,being the same property devised to me by my Aunt
Lou A.Margerum.--I have entered into an option agreement with
Andrew Balent and Margaret Balent,his wife,and certain members
of their family,to sell and convey this property to them if they
elect to take up the option.
This,my will,is a disposition of the real estate if the
said option is not taken up and is to be considered a disposition
of proceeds of sale of said real estate if said option is taken
up.
1 Saving only the proceeds of sale of the North Main
street property,I give,devise and bequeath unto my wife,SARA
R.GRIFFIN,if she survives me,all of the rest,residue and re-
mainder of my personal estate.
2.Should the option to purchase the real estate above
mentioned as having been given to Andrew Balent,et al.,not be
exercised then I give and devise my said North Main Street real
estate to my said wife,SARAH R.GRIFFIN,if she survives me,to
have and hold during her natural life.
3.In the event of said option not being exercised and
in the event that my said wife shall at any time have need for a

sum greater than is available from the net income of my said real
estate it is my will and I hereby specially direct that my said
wife,having a life estate,and the Executor and Trustee of my
estate shall have the full right and privilege of pledging the
Baid real estate as security for a mortgage or other loan,and as
to the desirability,need or necessity of procuring the loan here~
in authorized,and as to the amount thereof,my said wife shall
be the sole judge.The interest on any such loan shall be paid
from the income from the real estate but the principal payments
shall not be required until after the death of my said wife.
4.Likewise,I contemplate that it may and probably will
be necessary that a certain sum or sums be borrowed by my Executor
and Trustee to meet the payment of the Pennsylvania Transfer In-
heritance Tax and the Federal Estate Tax assessed against my
estate for the purpose of providing funds for the payment of thes
taxes,I expressly authorize and empower my said Executor to
negotiate for and obtain such sums or loans as may be necessary
for said purpose and to pledge the fee simple title to my said
real estate,following the life estate hereinabove devised to my
wife,as security for such mortgage or judgment loans~I direct
that such loans as ml~Y be made under the authority of the present
paragraph of this,my will,be so negotiated and made as to post-
pone repayments on account of principal of said proposed loan
until after the death of my said wife,the interest only,to be
kept paid by my said Executor and Trustee during my wife's life~
5~The remainder estate in my hereinabove mentioned real
II estate,following the death of my said wife,or,the proceeds of
sale thereof,should a certain option to purchase given by me to
Andrew Balent and/or Margaret Balent,his wife,et al.,be exer-
cised by the optionees,or either or any of them,according to the
tenor thereof,I give,devise and bequeath unto Mellon National
Bank and Trust Company,Washington Branch,as Trustee,to have anq
I to hold the same upon the following uses and trusts:
(a)To taxes,upkeep and insurance on the buildings upon
said real estate which are not paid by the optionees.
(b)To the payment of One Hundred and nO/IOO ($100.00)
Dollars per month to JULIA McCLELLAND GRIFFIN,widow of the late
Willard A.Griffin,Jr.,who died November 7,1952,said payments
to be expended by her,said Julia McClelland Griffin,for the care
and maintenance of her son,my grand-nephew,J.SHANNON GRIFFIN,
and such payments to continue until my said grand-nephew shall
have reached the Bge of twenty-one (21)years;the payments here-
in authorized are over and above and in addition to the cost of
the schooling of my said grand-nephew hereinafter authorized.
(c)When my said grand-nephew shall have reached the age
of twenty-one (21)years,said Executor and Trustee is hereby
authorized and directed to make said monthly $100.00 payments to
him until he,my said grand-nephew,shall have reached the age
of twenty-five (25)years,provided,that should my said grand-
nephew be married by the time he becomes twenty-one (21)years of
age he shall at that time receive any accumulations of principal
if said real estate be sold or shall receive any accumulations of
rentals if the said property shall not be sold.
(d)Before making any large payments to my said grand-
nephew,other than the $100.00 a month hereinabove specified,I
direct that my Executor and Trustee shall repay all loans incurr-
ed for the purpose of paying the Pennsylvania Transfer Inheritanc~
Tax and the Federal Estate Tax,with interest.
6.My said grand-nephew having reached the age of twanty-
.five (25)years and being then living,the trust and trusteeship
herein provided for shall cease and&termine and said Trustee shall
pay over unto my said grand-nephew any accumulated balance of
rents or partial payment of purchase price or in the event that
if the said real estate has not been sold turn over the real estate
to my said grand-nephew as specially provided in the next follow-
ing paragraph~
7.Contingent upon my said grand-nephew,J.SHANNON
GRIFFIN,attaining the age of twenty-five (25)years,and the
option to purchase my said real estate mentioned earlier in this,
my will,not having been exercised or taken up by the person(s)
entitled so to do,I give and devise my said real estate,being
heretofore mentioned as being located on North Main Street,Third
Ward,City of Washington,unto my said grand-nephew,J.Shannon
Griffin,his heirs and assigns,forever.
8.Should my said grand-nephew die before attaining said
age of twenty-five (25)years,and leaving a wife surviving,or a
wife and child or children surviving,the real estate mentioned
herein as being contingently devised to said J.Shannon Griffin
upon his attaining the age of twenty-five (25)years,I give and
devise my said real estate unto the surviving wife,and surviving
wife and Child,and wife and children,of said J.Shannon Griffin,
as the case may be,their heirs and assigns,forever,they to own
the same in the same estates and the same proportions as they would
inherit from their husband and father under the intestate laws of
the Commonwealth of Pennsylvania,the same dispo~ion to be made
of any sums remaining in the hands of the Executor or Trustee.
9.In the event that my said grand-nephew,J.SHANNON
GRIFFIN,shall die before reaching the ~ge of twenty-five (25)
years,and shall leave to survive him no wife nor child nor
children,I give and devise my said real estate to the following
persons,their heirs and assigns,forever,to have and to hold
the same in the following proportions:
To my nephew,SHELBY BRINSER,an undivided one-half (1/2)
interest therein.
To my niece,EMMA ELIZABETH GEISEL,an undivided one-half
(1/2)interest therein.
10.In the event that my said grand-nephew shall exper-
ience any serious illness,while the trust herein provided for
shall exist or be in force,or in the event that my said grand-
nephew shall wish to attend college or professional or other ad-
vanced school and said Trustee shall be of the opinion that in-
sufficient funds are available from any other source for such
additional advanced schooling,th~in either of said events,I
hereby authorize said Trustee,in its discretion,to expend from
any accumulation of rental-income or,if necessary to expend from
the principal of said trust estate,or to pledge,if necessary,
the real estate over which such Trustee has supervision,such sum
or sums as,in its opinion,are proper and necessary to fulfill
the needs and purposes mentioned.
11.Should the option to purchase,hereinabove mentioned,
be taken up and exercised,then I direct that the net proceeds
of sale of my said real estate,having been paid to said Mellon
National Bank and Trust Company,Washington Office,as Trustee,
in lieu of the title to said real estate and that said proceeds
of sale be inve~ed and reinvested by it,and held by it upon the
same uses and trusts and for the same periods as are,in foregoing
paragraphs in this,my will,set forth as applicable to the said
real estate,the proceeds of the sale thereof taking the place of
said real estate.
I hereby appoint MELLON NATIONAL BANK AND TRUST COMPANY,
WASHINGTON BRANCH,Executor of this,my Last Will and Testament,
and Trustee thereunder.
I direct that my Executor and Trustee employ JOSEPH C.
IN WITNESS WHEREOF,I have hereunto set my hand and seal
SPRIGGS,Attorney,as counsel for said estate,but if he should
for any reason not be able to serve then I direct that my Executa
