LAST WILL AND TESTAMENT
OF
JAMES T.CRISS.
I,JAMES T.CRISS,of the City of Pittsburgh,COIDlty of
Allegheny and state of Pennsylvania,being of sound mind and dispos-
ing memory,do hereby make,publish and declare this my Last Will and
Testament,hereby revoking any and all wills,or writings in the
nature thereof,by me at any time heretofore made.
FIRST:I give to my wife,ELIZABETH N.CRISS,all my house-
hold goods,furniture,bric-a-brac,jewelry,silverware and kitchen
utensils.
SECOND:I give my gold watch and chain,my diamond ring and
my pleasure automobile,if I own one at the time of my death,to COULTER
w.STEEB,now living at No.14 Dilworth Street,Pittsburgh,Pa.
THIRD:I give my Knights of Malta Charm,and the sum of
Five Hundred Dollars ($500.00)in cash,to my half-sister,MARY JANE
STEEB,now living at No.14 Dilworth Street,Pittsburgh,Pa.
FOURTH:I give and be~ueath to my god~hild,MYRTLE L.HOLMES,
wife of Harold Holmes,of Chicago,Illinois,the sum of Five Hundred
Dollars ($500.00).
FIFTH:I give and bequeath unto my son-in-law,GEORGE EGGER,
of No.15 Sim Street,Mt.Washington,Pittsburgh,Pa.,the sum of Five
Hundred Dollars ($500.00)in cash,one team of horses,one dump wagon
and one spring wagon,if I own them at the time of my death,.otherwise,
and in lieu thereof,I give him,in addition,the sum of Five Hundred
Dollars ($500.00)in cash~in such case a total of $1,000.00.
SIXTH:I nominate,constitute and appoint THE COLONIAL TRUST
COMPANY,a corporation organized under the laws of the State of Penn-
sylvania,having its office in the City of Pittsburgh,in said State,
Executor of this my Last Will and Testament.
SEVENTH:I direct my Executor to sell and convert into cash,

with the exception of the Liberty Bond hereinafter mentioned,and the
articles or chattels hereinbefore bequeathed,all of my estate,real,
personal and mixed,as soon as possible after my death,and one-third
(1/3)of the entire net proceeds from the sale and conversion of my re-
siduaryestate I give and bequeath to my wife,ELIZABETH N.CRISS.
EIGHTH:I give and bequeath to my grandchildren,J~.~S
EGGER,EUGENE EGGER,WESLEY EGGER,NORA EGGER and HOWARD EGGER,subject
to the trusts hereinafter created for them during their minority,all
the rest,residue and remainder of my estate,share and share alike,
after the same has been converted into cash.
NINTH:I direct that during the minority of each of my
aforesaid grandchildren the share of my estate hereinbefore given and
bequeathed to him or her shall be held by THE COLONIAL TRUST COMPANY,
aforesaid,in trust for him or her,upon the following terms and con-
ditions:
(a)To invest,reinvest and keep the same invested as
a separate fund,and to suffer and permit the net income therefrom to
be accumulated and invested,reinvested and kept invested as a part of
the principal of said fund,unless expended as hereinafter provided,
until each of my said respective grandchildren shall attain the age
of twenty-one (21)years;provided that if any of my said grandchildren
shall die under the age of twenty-one (21)years,and not leave issue
to survive him or her,the share or portion of my estate held in trust
for such grandchild of mine So dying shall,in equal parts,be added to
the shares of the survivors of my said grandchildren;and if any of my
said grandchildren shall die under the age of twenty-one (21)years,
leaving issue to survive him or her,the share or portion of my estate
held in trust for such grandchild of mine So dying shall,free and dis-
charged of all trusts,and either in cash or as the Trustee may elect,
in the same condition of investment in which it shall then be,vest ab-
solutely in such issue,share and share alike.

(b)To use and apply,if in the uncontrolled discretion of the
Trustee it is to the best interest of any of my said grandchildren so to
do,the entire net income from the share of the principal or corpus of
my estate held in trust for any grandchild of mine,for the education,
maintenance or general welfare of such grandchild;and if at any time,
in the uncontrolled discretion of the Trustee,it is right and proper
so to do,the Trustee may use and apply any portion of the principal or
corpus·of my estate held in trust for any grandchild of mine,for the
education,maintenance and general ~elfare of such grandchild of mine,
and in such case the trust as to so much of said principal or corpus so
used shall cease and determine.
(c)To pay,assign and transfer to each of my said grandchildren
as they shall attain the age of twenty-one (21)years,the entire corpus
or principal of my estate theretofore held in trust for him or her,and
free and discharged of all trusts,either in cash,or as the Trustee may
elect,in the same condition of investment in which it shall then be.
(d)To invest,reinvest and keep invested the said trust es-
tates in such investments as to the Trustee,in its uncontrolled discre-
tion,may seem right and proper,without limitation or restriction to
the investments which are now or hereafter may be required by law to be
held or made by Trustees.
(e)To determine net income by deducting from the gross rents,
revenues and income of the respective trust estates all taxes,federal,
state and local,and all expenses of administration,including from time
to time reasonable compensation to the Trustee for its services,but
nothing herein contained shall be construed to limit or restrict the
said Trustee to compensation from income merely;and the compensation
to the Trustee to be charged against principal shall be such as is de-
termined and fixed by the laws of the State of Pennsylvania in force at
the date of my death.
~TENTH:Neither the principal nor income of the trusts herein-

before created for my grandchildren shall be liable for any of their
debts,contracts,obligations or engagements,and may not be seized
or taken in execution for the payment of their debts,contracts,ob-
ligations or engagements,and may not be by them,or any of them,sold,
assigned,anticipated or pledged.
ELEVENTH:If all of my grandchildren above mentioned
should die in my lifetime and not leave issue to survive them,or
should all of my grandchildren survive me and die in their minority
without leaving issue to survive them,then and in such case I give
and bequeath the said share of my estate hereinbefore given and be-
queathed to my said grandchildren,share and share alike,to my wife,
ELIZABETH N.CRISS,MARY JANE STEEB,MYRTLE L.HOLMES and GEORGE EGGER.
TWELFTH:I give to and vest in The Colonial Trust Company,
and its successors,as Executor and Trustee under this my Will,in its
several and respective capacities,the following powers and authorities:
(a)To grant,bargain,sell and convey at either public or
private sale all of my estate,real and personal,in whole or in part,
for such price,either for cash,or partly for cash and partly for any
other thing deemed by it valuable,and upon such terms and conditions
as to it,in its uncontrolled discretion,may seem best,and to make,
execute,acknowledge and deliver any and all agreements and deeds
necessary to vest good and sufficient title in the purchaser or pur-
chasers thereof,without any liability on the part of such purchaser
or purchasers thereof to see to the application of the purchase money,
With like full power to sell and convey any and all real estate which
it may receive from the sale or exchange of any real estate,of which
I may die seized.
