FIRST.I appoint David C.Ackard,my beloved son,as Executor of this,my Last Will and Testament.I direct that no bond shall be required of the appointee named in this paragraph.My Executor,in addition to the powers conferred upon him by law,shall have the power to sell at public or private sale,to exchange or to lease,for any period of time,any real or personal property,and to give options for sales,exchanges or leases,for such prices and upon such terms or conditions as he deems proper. SECOND.I direct that all my just debts and funeral expenses be fully paid and satisfied as soon as conveniently may be after my death. THIRD.I give,devise and bequeath all my property,real, personal and mixed,wheresoever located and whether acquired before or after execution of this,my Last Will and Testament,to Gerald R.Ackard my beloved husband,absolutely,if he shall survive me for a period of sixty days. -1- , J FOURTH.In the event my aforesaid husband should fail to survive me for a period of sixty days,I give,devise and bequeath all my property,real,personal and mixed,wheresoever located and whether acquired before or after execution of this,my Last Will and Testament, to David C.Ackard and Dorothy Ackard Davis,my beloved children,in equal shares,absolutely,and in fee simple. FIFTH.In the event that anyone or more of my children shall predecease me leaving issue to survive me,I direct that the share of my estate that would have been received by the child so predeceasing me shall be divided among his issue per stirpes and not per capita.In the event that any of my children shall predecease me without leaving issue to survive me,I direct that the share of my estate such child would have received had he survived me shall be divided among my issue per stirpes and not per capita,except that if all of my issue so taking are in the same degree of consanguinity to me,they shall take in equal shares. SIXTH.In the event that none of the beneficiaries named in articles THIRD,FOURTH and FIFTH shall survive me,I direct that all my property,real,personal and mixed,wheresoever located and whether acquired before or after execution of this,my Last Will and Testament, shall pass and be distributed according to the scheme of distribution set out in the laws of Pennsylvania governing intestate descent.
