LAST WILL AND TESTAMENT II BOYD FOLKENS I of Eighty-Four R.D.#21 Washing- ton County,Pennsylvania,being of sound and disposing mind and memory,do makel publish and declare this my Last Will and Testamentl hereby revoking any and all wills or codicils heretofore by me made. FIRST:I direct that all my just debts and funeral expenses be paid as soon after my decease as conveniently may be. SECOND:I hereby bequeath and devise all my property,both real and personall to Florence Riggle as Trustee to hold the said real and personal property in trust for the benefit of my two sons,Bert Folkens and Fred Folkens,under the following terms and conditions: (a)It is my expressed desire that my two sons,Bert Folkens and Fred Folkens reside on the farm I now own during the period of their natural lives or until such time as their physical condition would not permit them to live on the said farm. (b)The trustee shall see that my two sons,Bert Folkens and Fred Folkensl have adequate provisions such as food,clothing and mainten- ance while they are living on the farm. (c)The trustee,if she so desiresl is hereby empowered to either personally move onto said farm and into the mansion house on the farm, herselfl or to provide a suitable tenant for said farm,howeverl it is my expressed desire that the tenant whoever he or she may be shall be complete ly acquainted with all matters pertaining to the physical condition of my two sonsl Bert Folkens and Fred Folkensl and that they,prior to occupancy of the premises,agree to properly and adequately care for my two sons,Bert Folkens and Fred Folkens. (d)I hereby authorize the trustee to lse such funds as may be necessary to purchase food,clothing and me ical supplies for the health and general welfare of my two sons,Bert Folkens and Fred Folkens;said moneys to be withdrawn from the trust fund. (e)In the event that unforseen problems arise,or in the event that the physical condition of my two sons is such that it is no longer practic- able to have them remain or live on the farm,then it is my desire that the trustee together with my other children hereinafter named,shall have the power and authority to determine what course of action should be taken with reference to my two sons,Bert Folkens and Fred Folkens. (f)In the event of the death,or other matters whereby my two sons,Bert Folkens and Fred Folkens,are not able to live on the farm,then it is my desire that the farm be sold by the trustee and that the trustee dis- tribute the proceeds therefrom amongst my children,in equal shares,namel , Charles Folkens,Sara McCullough,Florence Riggle,and Betty Hulic.How- ever,the trustee shall,before any such distribution,retain from said personalty sufficient funds for the general welfare of my two sons,Bert Folkens and Fred Folkens,that might be necessary for their benefit,and this fund shall remain in the trust fund. (g)In the event of the death,or other matters whereby my two sons,Bert Folkens and Fred Folkens,are not able to live on the farm,then it is my desire that all my personal property be divided and distributed in equal shares amongst my children,namely:Charles Folkens,Sara McCullou h, Florence Riggle and Betty Hulic.However,the trustee shall,before any Page 2. · . such distributionl retain from said personalty sufficient funds for the general welfare of my two sonsl Bert Folkens and Fred Folkens.that might be neces sary for their benefit,and this fund shall remain in the trust fund. \. T HI RD:In the event of the death or incapacity of the above named Trustee.Florence Riggle,then I hereby nominate and appoint my son,Charles Folkens.to be the Trustee with the same powers and privileges and duties extended herein to the said Florence Riggle as Trustee. FOURTH:I hereby nominate.constitute and appoint my daughter.Florence Riggle,to be the Executrix of this.my Last Will and Testament and direct that no bond shall be required of her.
