I,MARY T.DALY,the within named testatrix,do hereby
make and publish this Codicil,to be added to my Last Will and
Testament,dated April 18th,1941,in manner following,to wit:
1.I do hereby modify the Tenth Paragraph and give to
Hannie Thompson the sum of $500.00,instead of the sum of $250.00
2.I do hereby modify the Eleventh Paragraph and give
to John Parchmont the sum of $500.00,instead of the sum of $250.0.

Sixteenth.I do hereby authorize,Empower anddirect my said
executors hereinafter named,and the survivor of them,to sell,
dispose of and convey in fee simple,all the rest,residue and
remainder of my real estate.either by public or private sale or sales,
without any liability of the pu~"cbasers for the application,non-
application or misapplication of the purchase mon:"es.This shall be
a continuing power and may be exercised at any time while any
portion of my estate remains unsettled.
Seventeenth.Notwitrstanding anything in this Will to the
contrary appearing,the devises and bequests,both as to principal
and income,shall not be liable for any of the debts or obligations
of said beneficiaries,but shall be for the sole and exclusive use
of the respective beneficiaries herein named,and shall not be
subject to attachment or assigned by ~r-em or any of them.

I,MARY T.DALY,
of Borough of Charleroi ,County of Wa shington ,
and State of Pennsylvania,being of sound mind and memory,do hereby make,
publish and declare this to be my Last Will and Testament,in manner and form following,hereby
revoking any will or wills heretofore made by me.
First.I direct that all my iust debts and funeral expenses be fully paid and satisfied,as soon
as conveniently may be,after my decease.
Second.I give and bequeath to my daughter,MARY ~LY MacFARI~ND
all of my jewelry,clothing,personal effects,household goods and '
furniture,with the exception of bequest made in Paragraph Eighth
hereafter.
Third.I give and bequeath unto my daughter,MARY DAL~MacFARLAND,
and her:husband,BERNARD A•.MacFARLAND,the sum of Six Thousand Fi ve
Hundred ($6,500.00)Dollars,IN TRUST,NEVERTHELESS,for the folloWing
uses and purposes,and none other,to wit:
(a)TO HAVE AND TO HOLD,manage,sell~invest and reinvest,
the same from time to time,in their discretion,when this
becomes advisable or necessary,in interest bearing securities
or First Mortgages upon improved real estute,irrespective of any
statutes now or hereafte~in force limiting the investQents of
Trustees;and to collee t,re ceive and receipt for the inc ane,
issues and dividends and profits arising therefrom,when due and
.payable,and,after paying thereout the expenses incident to the
management of the Tr ust,includ ing th e Trustees t comper::sa tion,the
said net income shall be accummulated for the benefit cf my
grandson,BERNARD DALY MacFARLAND,and my granddaughter,ELIZABETH
ANN MacFARLAND,in proportions and amounts hereinafter particularly
set forth,during their respective minorities.
(b)When ~y grandchildren arrive respectively at the age
of fifteen (15)years,I hereby authorize my said Trustees to
use the said grandchildren's respective pro)ortionate shares
of the net income,or'such part thereof as shall be reasonably
re~ired or necessary,for their respective proper maintenance
and education,until they respectively arrive at the age of
twenty-one (21)years,at which time,and,thereafter,the net
income shall be paid direct to them,in semi-annuall installments,
until they respectively arrive at the age of twenty-fiv~(25)
years.When they respectively arrive at the age of twe.ty-five
(25)years,their respective shares of the corpus of this trust
shall be termin3.ted,together with 0.11 accummulated or nccrucd
";'il~U,.j,6~{ldj,:et(,)belonging,less'the 'l'rustees'administration
expenses,and the said corpus of tl'is trust and income shall be
paid to them respectively.
(c)In case of the death of either or both of my said grand-
children before they respectively attain the age of twe~ty-five
(25)years,this Trust shall cease as to the deceased g~andchild
or grandchildr~n,and the corpus t together with.all acc~mn~latedoraccruedincometheretobelonglngshallbepaldtohlSorher
next of'kin,'under the Intestate Laws of the Commonwealth of
Pennsylvania,in the same manner as woul~be do~e ha~he or sre
died seized and in possession thereof,a~the tlme 01 such death
or deaths.
(d)I give and bequeath Five Hundred (~500.00j Dollars of the
principal sum of this Trust to my grandson,BERNARD DALY MacFARLAND,
and I give and bequeath Six Thousand ($0,000.00)Dollars of the
principal sum of this Trust to my granddaughter,ELIZABETH ANN
MacFARLAND.I make this difference for the reason that Bernard
Daly MacFar~and received the proceeds from an insurance policy
provided for him by my deceased husband,Kerfoot W.Daly.My
deceased husband having intended to make a similar pr,ovision for
Elizabeth Ann MacFarland,but having died before such arrangementshadbeencompleted.
Fourth.I give and bequeath urlto HARLEY L.SWIFT,the
3um of One Thousand ($l,OOO.OJ)Dollars.In the event that Harley L.
Swift should predece~se me,I direct that this legacy shall not lapse,
~ut that the same shall be paid jointly to his wife,Mary SWift,and
~is daughter,Gladys Jane SWift,or the survivor of t~em.
Fifth.I give and bequeath untq my sister-ih-law,ATHALIA DALY
McKEA~,the sum of Five Thousand ($5,000.00)Dollars.I further give
and bequeath unto CHARLEROI SAyINGS AND TRUST COMPANY,the sum of
Fifteen Thousand ($15,000.00)~ollars,IN TRUST,to invest and reinvest
in interest bearing First Mortgages upon improved real estate or in
lawful investments for fiduciaries,and to collect,receive und I
receipt for the income therefrom,and after paying the expenses incident
to the management of said Trust (including the Trustee's com'::ission),
the net income therefrom shall be paid at least quarterly,to my said ,
sister-in-law,ATHALIA DALY McKEAN,during the term of her natural
li fe.Upon the dea th of the said Athalia Daly McKean,this Trust shall I
cease and.the remainder thereof,together wi th any accumrnula ted or
accrued income ttereto belonging (less the epenses of the administration
thereof)shall be paid to my daughter,MARY DALY MacFARLAND,discrar~ed
of the trust herein created.
Sixth.I give and bequeath unto my cousin,BELLE PATTEN,of Munhall,
Pennsylvania,the sum of Three Hundred ($300.00)~ollars.
Seventh.I give and bequeath unto ELIZABETH M.CULLER,of
Charleroi,Pennsylvania,the sum of Three Hundred ($30J.OJ)Dollars.
Eighth.I give and bequeath to CLARK LAUGHLIN,of Pittsburgh,
Pennsylvania,the mahogany clock which I received ~rom the Estate of
Ella B.Swift.
Ninth.I give and bequeath unto my son-in-law,BERNARD A.
MacFARLAND,the sum of Four Thousand (~4,OOO.OJ)Dollars,in appreciatio~
of the many kindnesses whict he has extended in my behalf.
Tenth.I give and bequeath unto NANNIE THOMPSCN,the sum of Two
Hundred Fifty (~250.00)Dollars.
Eleventh.I give and bequeath unto JOHN PARCHMONT the sum 0 f
1wo Hundred Fifty ($250.00)Dollars.
Twelfth.I give and bequeath unto the CHARLEROI SAVINGS AND TRUST I
COMPANY,its successors and,assigns,in TRUST,NEVERTHELESS,the sum of
One Thousand Five Hundred ($1,500.00)Dollars and direct that the in-
come therefrom shall be used in order to keep in good shape ani
condition the monument and headstones at the graves of my deceased
husband,Kerfoot W.Daly,and myself,and for the purpose of decorating
the said graves from time to time.
Thirteenth.I give and bequeath unto the CHARLEROI SAVINGS AND TRUST
00 MPANY,its successors andassigns,IN TRUST,NEVERTHELESS,the sum of
Five Hundred ($500.00)Dollars and direct that the inco~therefrom
